The following are the Chariot Charters Terms & Conditions:
Charters cancelled 6 Calendar Days or more from the scheduled pickup time will incur a 25% cancellation fee. No refunds will be provided for charters canceled within 5 days of the scheduled pickup date and time. For example, if a charter is scheduled to depart on a Sunday at 10:00am the cancellation must be received prior to the previous Tuesday at 10:00am in order for the customer to receive a 75% refund.
Customers whose charters exceed the pre-arranged time by more than 15 minutes will automatically incur overage charges billed in 30 minute increments. For example, if a charter for $900 is scheduled for 6 hours but actually takes 6 hours and 18 minutes, the customer would be charged an additional $75 (0.5 hours x $900/6 per hour).
Any change in service at the request of the customer resulting in additional miles or hours of service shall be subject to an additional charge. Tolls, parking fees and other similar charges will be added to the total service fee for which Customer is responsible. Chariot will notify the customer of any expected charges that may be incurred at the time of booking, but any additional fees unforeseen prior to the departure of the charter are the responsibility of the Customer.
Customers are responsible for notifying Chariot at the time of booking of any special needs for disabled passenger(s) during the period of charter service.
Charter bookings are subject to availability. Chariot reserves the right to cancel an order and refund the customer.
Chariot reserves the right to assign the charter to a licensed, insured charter operator, at its sole discretion. Chariot reserves the right to transfer or assign any and all of its rights and obligations under these terms to third party operators. All third party operators utilized by Chariot will be properly licensed for the jurisdiction in which the charter will take place, and will carry the requisite level of insurance as set forth by local or state regulations. In the event of an assignment to a third party operator, Chariot will inform the client prior to commencement of the trip.
Customers assume full liability for any damage to Chariot’s vehicles due to the activity of their passengers. Any additional charges incurred by Chariot to repair or clean the vehicle due to the activities of a customer’s passengers will be the full responsibility of the customer.
Chariot does not assume any responsibility whatsoever for any personal property of passengers. Baggage and all other personal property of passengers will be transported only at passengers' own risk.
Chariot and its service providers reserve the right to refuse to transport any unruly or disruptive persons, including persons under the influence of intoxicating liquor or drugs, or who are, or Chariot or its service providers believe may become, threatening or abusive to other persons in any manner.
Possession of firearms or weapons of any sort, explosives or fireworks (whether in baggage or on the person) is strictly forbidden on Chariot vehicles.
Client acknowledges and agrees that, during the term of this Agreement, all Chariot drivers will be allowed and provided an opportunity to take any and all legally required meal and rest breaks (collectively “Breaks”). Client agrees that neither they nor Chariot may require a Chariot driver to forego a Break regardless of then-current transportation needs or scheduling.
CHARIOT SHALL NOT HAVE ANY LIABILITY TO ANY CUSTOMER OR PASSENGER FOR ANY SPECIAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS AND OPPORTUNITY COSTS, WHETHER FORESEEABLE OR NOT, ARISING WITH RESPECT TO OR IN CONNECTION WITH CHARIOT’S CHARTER SERVICES, WHETHER ARISING IN CONTRACT (INCLUDING WARRANTY), TORT (INCLUDING ACTIVE, PASSIVE OR IMPUTED NEGLIGENCE) OR OTHERWISE.
